Using images

An image can be defined as any visual representation protected by the Copyright Act. It may be an artistic work or a photographic work that reach the threshold of originality or it may be an explanatory drawing, a photograph that is protected by a photographer’s copyright, or a chart protected by catalogue protection. Not all visual presentations are protected by the Copyright Act. The existence of copyright protection is interpreted on a case-by-case basis. For example, in the Copyright Council’s case 2011:12, the technical drawings of a vehicle’s motor and electrical systems published in a textbook were not works covered by Section 1 of the Copyright Act.
